Intellectual Property

The world is increasingly coming to recognize the value of intellectual property, particularly in copyright, trademark and computerized products.

Lambert & Lambert PLC helps business clients protect their ideas and creations from theft or misuse. The process of affording this protection to clients begins at the inception of the creative process and continues through distribution of the resulting program or product. Our efforts in this legal realm have been focused on the areas described below.

Trademarks. We have assisted clients in registering and protecting their trademarks. The site of choice for registering Trademarks (and Service Marks) is the US Patent and Trademark Office. This process has recently been streamlined and simplified, but still requires attorney services shepherding the Trademark through the process.

The USPTO is not the only site for registering Trademarks. On occasion, it makes sense to register in Michigan. The Madrid System for the International Registrations or marks is also becoming more relevant in this era of enhanced international commerce.

Once registered, the Trademark must be protected. We have represented clients in such endeavors on several occasions, ranging from Internet demands to defending against Louisiana based interlopers.

Copyright. Copyright protection can extend to any original expression of ideas, whether presented in the form of words, pictures, symbols or digital media. Since registration of copyrights is much less prevalent than with trademarks, our copyright practice concentrates on advising clients on the eligibility of any work for copyright protection, and advising them of their legal options when infringement is detected.

Computer Law. We were recently employed to protect our client's software rights from palming off by a competitor. Such claims involve complex contentions regarding the similarity (or alleged differences) between the competing products. After contentious litigation, we were able to settle the claim in a manner that adequately protects our client's intellectual property.
